Terms of Service

By downloading, installing, or using the myfestival. mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). The App is provided by MYSWAY APP INC(“we”, “us”). If you do not agree to these Terms, do not use the App.

You must be at least 13 years old (or the minimum digital-consent age in your country) to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at kaldenbess@gmail.com if you suspect unauthorized access.

You agree not to use the App to:

• Violate any applicable law or third-party rights.
• Harass, threaten, impersonate, or harm other users.
• Post content that is illegal, hateful, sexually explicit, or infringes intellectual property.
• Distribute spam, malware, phishing links, or attempt to reverse-engineer the App or our backend.
• Interfere with the operation of the App or with other users’ enjoyment of it.

We may suspend or terminate any account at our discretion for violations of these rules.

You retain ownership of the content you post (chat messages, photos, profile details). By posting it through the App, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content solely as necessary to operate the App and the features you participate in. You represent that you have all rights necessary to grant this license and that your content does not violate any law or third-party rights.

The App may surface a marketplace where third-party vendors offer goods or services at participating festivals. Transactions are entered into directly between you and the vendor. We facilitate ordering and, where applicable, payment processing, but we are not the seller of record and do not guarantee the quality, safety, availability, or legality of any vendor offering. Refund and fulfillment policies are set by each vendor.

Features that rely on your device’s location or Bluetooth radios (e.g. festival map, nearby attendees, offline mesh chat) are optional and require your explicit permission. Disabling these permissions will limit the corresponding features but will not prevent core use of the App.

The App and all related software, design, trademarks, and logos are the property of MYSWAY APP INC or its licensors. These Terms do not grant you any right to use our trademarks or branding without our prior written permission.

The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, nor that any defects will be corrected.

To the maximum extent permitted by law, MYSWAY APP INC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the App. Our total cumulative liability for any claims arising from these Terms or the App will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) CAD $50.

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Montreal, Quebec for any dispute arising from these Terms, except where prohibited by applicable consumer-protection law.

We may revise these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
